Agreement Regarding the Handling of Personal Information

1. Introduction

Considering the protection of personal information to be one of its most important social duties as an Internet business operator, CYBIRD Co., Ltd. (hereinafter “CYBIRD”) handles its customers’ personal information appropriately in accordance with its Personal Information Protection Policy and its Personal Information Protection Management System.

CYBIRD has also been certified and granted the use of the Privacy Mark by the Japan Information Processing Development Corporation (JIPDEC), identifying it as a company that takes appropriate security management and protection measures to safeguard personal information [certification number: 11820255(06)].

Moreover, in accordance with this Agreement Regarding the Handling of Personal Information, CYBIRD operates and manages its website in such a manner that customers can feel secure in navigating it.

This Agreement shall apply whenever customers provide their personal information through this website operated and managed by CYBIRD. However, when providing personal information, there may be instances in which extraordinary provisions that differ from this Agreement apply, and in such instances, the extraordinary provisions shall take precedence.

Customers exercise their sole discretion in choosing whether or not to provide their personal information. Please understand, however, that some services on this website may not be available to customers who choose not to provide personal information.

2. Concerning the Handling of Personal Information

2-1. Definition of Personal Information

Personal information as defined in this Agreement refers to information that can be used to identify or is personal to individual customers (such as their name, address, telephone number or email address) that customers provide through this website operated and managed by CYBIRD.

2-2. Purpose of Use of Personal Information

Customers will be asked to provide personal information only when this is needed in order for CYBIRD to provide the following services on this website.

(1) When responding to customer questions and inquiries
(2) To confirm the customer’s identity when they use the website’s services

Personal information will also be used as statistical data to such an extent as is needed to improve services. Personal information provided by customers will be used only within the range of stated purposes of use. Except for in the following cases, personal information will never be used for any purpose other than the stated purposes of use.

(1) When the customer has given their prior consent to such disclosure
(2) When such disclosure is required by law
(3) When such disclosure is considered necessary for protecting the life, person or property of a member of the public, and the consent of the relevant individual cannot be readily obtained

2-3. Acquisition of Personal Information

CYBIRD collects its customers’ personal information directly from the customers themselves. We do not collect customer information indirectly from third parties, through deception, or in an otherwise improper manner. However, in the case of the mobile website, in the interests of membership management, we acquire the ID code set by the mobile telecommunications carrier on the customer’s mobile phone device.

When supplying personal information, customers are requested to personally enter their own information correctly. If the information provided by a customer contains errors or is outdated, this may prevent the customer from accessing services on this website.

2-4. Disclosure of Personal Information to Third Parties

CYBIRD will not disclose or provide personal information supplied by customers to any third parties, except in the following circumstances.

(1) When the customer has given their prior consent to such disclosure
(2) When the handling of personal information is outsourced to a cooperating company, affiliate or outsourcing company with which CYBIRD has a personal information non-disclosure agreement and the information is used only within the range necessary to achieve the purpose of use that has been specified to the customer
(3) When personal information is processed into statistical data, etc. and the identity of the individuals can no longer be determined
(4) When such disclosure is required by law
(5) When such disclosure is considered necessary for protecting the life, person or property of a member of the public, and consent of the customer cannot be readily obtained
(6) When such disclosure is considered especially necessary for the promotion of public health or the healthy development of children, and consent of the information holder cannot be readily obtained

2-5. Careful management of Personal Information

When customers provide CYBIRD with personal information, as a precaution against unauthorized access by third parties, SSL (Secure Sockets Layer) encryption or equivalent security technology will be used to receive the information in an effort to safeguard its security.

Moreover, personal information provided by customers shall be strictly managed and preventive measures against loss, destruction, alteration, leakage, etc. shall be taken.

2-6. Requests for Reviewing, Correcting or Deleting Personal Information

When customers are asked to provide personal information, a clearly marked inquiry window will appear on the screen. Customers who wish to review the personal information they have provided, correct or delete incorrectly stated personal information, or refuse usage or provision of personal information are asked to make their request using this inquiry window. After the person making the request has been confirmed as being the person to whom the personal information pertains, within a reasonable period of time the personal information will be disclosed, corrected or deleted accordingly.

However, CYBIRD may be unable to respond to such requests if one or more of the following circumstances apply.

(1) When there is concern that clarifying the existence or non-existence of said personal information would pose a risk of harm to the life, body, property, or other rights or interests of the individual or any third party
(2) When there is concern that clarifying the existence or non-existence of said personal information would serve to advise or induce illegal or improper actions
(3) When there is concern that clarifying the existence or non-existence of said personal information would pose a risk of impairing national security, of harming relationships of trust with other countries or international organizations, or of imposing disadvantages in negotiations with other countries or international organizations
(4) When there is concern that clarifying the existence or non-existence of said personal information would pose a risk of hindering the prevention, crackdown or investigation of crimes or the maintenance of other public safety and order

2-7. Protection of Personal Information of Customers Under the Age of 16

CYBIRD takes the greatest possible care in protecting the personal information of customers under the age of 16. Customers under the age of 16 should always obtain the consent of a parent or guardian before providing their personal data.

3. Disposal of Unnecessary Personal Information

In accordance with CYBIRD’s in-house regulations, personal information provided by customers will be stored appropriately and, when no longer necessary for business purposes, will be disposed of by an appropriate method.

4. Protection of Personal Information on Linked Sites

CYBIRD cannot accept any responsibility for the handling of personal information provided by customers to the websites of other business operators or individuals linked to from this website operated and managed by CYBIRD.

5. Compliance with Applicable Laws, Regulations and Other Standards

CYBIRD will comply with the Act on the Protection of Personal Information and other related laws, regulations and standards.

6. Changes to this Agreement

CYBIRD may make changes to this Agreement in accordance with changes in relevant laws and regulations.
